FAMILY-BASED PETITIONS

If you are a U.S. Citizen or Lawful Permanent Resident of the U.S., family-based petitions allow you to sponsor certain family members to immigrate to the United States to obtain their Legal Permanent Resident status (“Green Card”). To be eligible to sponsor a family member, the U.S. petitioner must establish they have a qualifying relationship with the foreign national relative, and sufficient financial means to support there sponsored relative(s). We know that family unity is very important and take the time and interest to learn about you and your family members, your challenges and joys, and the details that will ensure a successful family-based application. We will help your family determine if you or your loved ones qualify for any of the family-based immigration options. 

FIANCEE VISAS

A fiancé(e) K-1 nonimmigrant visa allows a U.S. Citizen to bring his or her foreign national fiancé(e) to the United States with the intention of marrying within 90 days of arrival into the United States. The foreign-citizen will then need to apply for adjustment of status to a Legal Permanent Resident Status. Eligible children of K-1 visa applicants can receive K-2 visas. To qualify for the fiancé(e) visa, the U.S. Citizen petitioner and their foreign national fiancé(e) must establish, that they intend to marry within 90 days of the foreign national fiancé(e) entering the U.S., that they are lawfully able to marry in the intended jurisdiction in the U.S., and that the two have met in person within the last 2 years (unless they can demonstrate that meeting in person would create extreme hardship or violate strong and long-established customs.). 

CONSULAR PROCESSING

U.S. Department of State consular officers posted at U.S. Embassies and Consulates around the world adjudicate both nonimmigrant and immigrant visas. These visas include both family-based (e.g., marriage, children) and non-immigrant visas (e.g., religious), as well as visitor visas, and student visas.  The consular officers review and make decisions regarding each applicant’s eligibility for the visa for which he or she is applying, and the applicant’s “admissibility” to the United States under U.S. immigration law.  A visa applicant may be required to be interviewed by a consular officer, be subject to a medical exam and criminal background checks, provide evidence of financial support and ties in the U.S., or ties to one’s home country. Consular processing is case-specific, and requires constant communication between the client and our office. We thoroughly prepare our clients for their consular interviews for immigrant and non-immigrant visas.

WAIVERS OF INADMISSIBILITY

Anyone who seeks to enter the United States or obtain residence must be "admissible" to the U.S.  This means that the person seeking admission may not be among any of the classes of individuals deemed ineligible by law to enter the U.S. ("inadmissible"). U.S immigration law provides that certain classes of individuals may not be admitted without a waiver, or an exception.  It is common for individuals to have admissibility issues that need to be resolved to allow them to obtain an immigrant or non-immigrant visa. Often times this requires individuals to obtain a waiver. A waiver of inadmissibility is an official determination by the U.S. government to allow an otherwise ineligible person to enter the United States. We have prepared numerous waivers addressing a variety of admissibility issues including the I-601A, I-601, and I-212. The application and use of waivers is very complex, we can help you through the process and will work diligently with you throughout the case.

TOURIST VISAS

Individuals entering the U.S. for a limited time to visit (typically 90 days or less, but up to 1 year). These individuals must prove to consular and border officials that they are entering the U.S. temporarily for the purpose of visiting the U.S. (i.e. for a vacation, to visit friends and family, etc.). For visa issuance, the traveler will need to demonstrate that they maintain strong ties to their home country, sufficient funds available to pay for their trip, and will return to their home country at the conclusion of their visit. The B-2 visa holder is not allowed to engage in employment nor may they perform work as a freelancer or independent contractor.

REMOVAL DEFENSE

Once referred to as "deportation", removal is the process of the U.S. government determining that a non-U.S. citizen, whether in the U.S. illegally or with a green card -- must be removed from the United States. The removal process is complicated, and the stakes are high. Legal representation is essential to develop a defense strategy, preserve the rights of the alien, and present the best case possible in immigration court.
